Supreme Court Dismisses John Mahama’s Application To Reopen His Case

The Supreme Court has dismissed John Dramani Mahama’s application to reopen his case in the ongoing 2020 election petition trial.

According to the Court, the petitioner, inter alia, has not adduced enough evidence to convince the bench for the case to be re-open.

Reading the ruling on Tuesday, February 16, Presiding Judge Justice Kwasi Anin-Yeboah said even at the time the application was filed, the petitioner, as well as the respondents, have closed their case.

Summary of ruling

Petitioner has not demonstrated that it intends to obtain evidence that has the potential to change the outcome of the case neither has he showed that such evidence was not obtainable earlier.

There can also not be a need to seek clarification from this intended witness of the 1st respondent because this witness has not even testified. Court once again emphasized that success of petitioner’s case is dependent on his evidence.

Arguments raised by petitioner is almost the same as those raised in the objection to the 1st respondents decision not to testify.

The EC Chairperson is not on trial and cannot be asked to vindicate herself. Application dismissed
