Once again Adidas and Nike are in News. But this time Adidas has taken this war to a new level. In a complaint filed in Texas District Court on Friday 10th June 2022 Adidas suing Nike, but this time it’s a federal lawsuit. 

This is not the first time that Adidas and Nike are fighting. The history goes back to 2005 when Nike sued Adidas alleging that Adidas shoes violated two patents related to shoe design. However, the case was dropped in 2007 when both Adidas and Nike agreed on mutual terms.

Earlier in 2015 Adidas and Nike were fighting over the Nike SNKRS app and Adidas Confirmed. Adidas Confirmed was launched in 2015, a tool that would make buying exclusive products easier and fairer for everyone.

Later some days Nike launched its SNKRS app which was rolled in a password-protected capacity before a global launch in May 2015. The apps are also included in the complaint.

Reason Why Adidas Suing Nike

Adidas has claimed that Nike ‘ Knowingly and Intentionally’ infringed on nine patents related to Adidas Proprietary Athletic Technology. The Nike’s Run Club app, Nike Training Club app, and Nike SNKRS app have the containing infringing elements like audio feedback during workouts, GPS tracking, and training plans. 

Adidas accused Nike’s adapt system in which the shoelaces tighten or loosen automatically based on what the wearer is doing. Also, Adidas suing Nike for the patent of the “Intelligent Footwear” system that adjusts the shape of shoe cushioning.

The auto-lacing technology was first explored by Nike Smart Shoes in 2016 when back-to-the-future-inspired Mag shoes were released with an early version of the technology. The more redefined technology was showcased in 2019 by Nike. 

However Adidas claims that Adidas_1 was the first shoe ever that sensed and adjusted to the comfort of the wearer when worn, it was announced by Adidas in 2004 and was released in 2005. 

Adidas lawsuit also follows Nike’s December complaint against the company in Oregon Federal Court and the US International Trade Commission where Nike accused Adidas shoes of infringing patents related to the Flyknit Sneaker design. 

“Adidas has long been a leader in mobile technology, including technology related to mobile fitness and mobile purchases,” Adidas claims in the suit. “Adidas was the first in the industry to comprehensively bring data analytics to athletes.”

Adidas has asked the court for an unspecified amount of money damages and an order to block Nike from infringing. The bad blood between Adidas and Nike is long known but this is the first time Adidas has filed a complaint in Federal Court.
